Welcome to FragSwap. By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our platform.

FragSwap is a marketplace that connects saltwater coral hobbyists for buying, selling, trading, and exchanging coral frags and related items. We provide the platform but do not participate in the actual transactions between users.

2. User Accounts

2.1 Account Creation: You must create an account to access certain features. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be at least 18 years old or have parental consent

2.2 Account Responsibility: You are responsible for all activities that occur under your account.

3. Listings and Transactions

3.1 Creating Listings: When creating a listing, you must:

• Provide accurate descriptions and photos
• Set fair and honest pricing
• Only list items you actually possess and have the right to sell
• Comply with all local, state, and federal laws regarding coral trade

3.2 Transactions: FragSwap is not a party to any transactions. We do not:

• Process payments or handle money
• Ship or deliver items
• Guarantee the quality, safety, or legality of items
• Verify the accuracy of listings

3.3 User Responsibility: Users are solely responsible for completing transactions, payment arrangements, shipping, and resolving any disputes.

4. Prohibited Activities

You agree NOT to:

• List illegal items or items that violate CITES regulations
• Engage in fraudulent, deceptive, or misleading practices
• Harass, threaten, or abuse other users
• Use automated bots or scrapers on our platform
• Manipulate prices or engage in shill bidding
• Post spam, advertisements, or unrelated content
• Violate any applicable laws or regulations
• Impersonate others or create multiple accounts to evade bans

5. Intellectual Property

5.1 User Content: You retain ownership of photos and content you upload. By posting content, you grant FragSwap a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on our platform.

5.2 Platform Content: The FragSwap website, logo, design, and code are protected by copyright and other intellectual property laws. You may not copy, modify, or distribute our platform without permission.

6. Disclaimers and Limitation of Liability

6.1 "As Is" Service: FragSwap is provided "as is" without warranties of any kind. We do not guarantee:

• The accuracy, completeness, or reliability of listings
• That users will complete transactions
• Uninterrupted or error-free service
• The quality or legality of items listed

6.2 Limitation of Liability: To the maximum extent permitted by law, FragSwap and its operators shall not be liable for:

• Direct, indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from user transactions or interactions
• Third-party actions or content

7. Indemnification

You agree to indemnify and hold harmless FragSwap, its operators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the platform
• Your listings or transactions
• Your violation of these Terms
• Your violation of any laws or third-party rights

8. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, you must cease all use of the platform.

9. Dispute Resolution

9.1 User Disputes: Disputes between users must be resolved privately. FragSwap is not responsible for mediating or resolving user disputes.

9.2 Governing Law: These Terms shall be governed by the laws of Ontario, Canada. Any disputes shall be resolved in the courts of Ontario.

10. Changes to Terms

We may update these Terms at any time. We will notify users of material changes by posting a notice on the platform. Your continued use of FragSwap after changes constitutes acceptance of the updated Terms.
